Terms of Service

1. Scope of Application

1.1 Operator and Services

Menzemedia GmbH ("Mallorca.com", "we", "us") operates under the name "Mallorca.com" a multilingual website and other services, local and mobile applications (hereinafter together "Mallorca.com Services").

1.2 Terms of Service

These General Terms of Service contain the basic rules for using the Mallorca.com Services. Deviating terms and conditions of the user do not apply unless expressly agreed by both parties in writing.

1.3 Languages

The Terms of Service and Mallorca.com Services are available in German, English, Spanish and Catalan.

2. Contract Conclusion and User Account

2.1 Registration

Using Mallorca.com Services may require registration. Through registration, a contract is concluded between the user and Mallorca.com for the use of the services.

2.2 Requirements

Users must be of legal age or have consent from a legal guardian. In Spain, pursuant to LOPD, the minimum age is 14 years.

For the social features of the Mallorca.com app under section 13.1 — such as posts, following and likes and, in future, comments and direct messages — a minimum age of 16 years applies instead; the consent of a legal guardian does not replace it. Section 13 takes precedence in this respect.

2.3 Account Information

The user is obliged to provide truthful information during registration and keep it up to date. The user account is not transferable.

2.4 Access Credentials

The user is responsible for the secure storage of their access credentials. In case of suspected misuse, the password must be changed immediately and we must be informed.

3. Free Basic Services

3.1 Classified Ads

Posting classified ads for private users is generally free of charge. Mallorca.com provides a platform where users can publish ads.

3.2 Automatic Translation

Ads are automatically translated into all ten languages (German, English, Spanish, Catalan, Dutch, French, Swedish, Italian, Polish, Portuguese). This translation is machine-generated and without guarantee of accuracy.

3.3 Commissions

For classifieds and business-directory listings, Mallorca.com does not charge commissions on transactions between users; purchases and sales there are conducted directly between users. The brokerage of experiences is additionally governed by the supplier terms (partner agreement): the respective supplier pays a brokerage commission (currently 15% of the booking price); buyers pay no commission.

4. Paid Additional Services

4.1 Premium Features (optional)

Mallorca.com may offer paid additional services, such as:

  • Highlighting ads
  • Premium placement
  • Extended features for commercial users

4.2 Price Transparency

Prices for paid services are clearly displayed before purchase. There are no hidden fees.

4.3 Payment Terms

Payment is made in advance. Accepted payment methods are displayed at checkout.

5. Directory Services

5.1 Business Directory

Mallorca.com operates a business directory in which companies and service providers in Mallorca can be listed. The directory contains both automatically imported entries from publicly available sources and entries created or claimed by users themselves.

5.2 Claiming an Entry

Commercial users can claim an existing directory entry, provided they are the legitimate owner or an authorized representative of the listed business. By claiming an entry, the user confirms that they are authorized to act on behalf of the business. Mallorca.com reserves the right to request proof of authorization.

5.3 Registering a New Entry

Commercial users can create a new directory entry. Truthful and current information regarding company name, industry, location, and contact details is required. Mallorca.com assumes no liability for the accuracy of the information provided.

5.4 Directory Plans

Different plans are available for directory entries:

  • Free: Basic entry with fundamental contact details and location.
  • Plus (Paid): Enhanced entry with additional features such as photos, opening hours, and description.
  • Premium (Paid): Complete entry with all features and preferred placement in search results.

The exact features and prices of each plan are displayed on the directory registration page. Paid plans are offered as monthly or annual subscriptions.

5.5 Payment Processing

Payment processing for paid directory plans is handled by the payment service provider Stripe (see Privacy Policy). By ordering a paid plan, the user agrees to Stripe's terms of service.

5.6 Right of Withdrawal

A 14-day right of withdrawal from the date of contract conclusion applies to paid directory plans in accordance with § 355 BGB (German Civil Code). Withdrawal can be declared via the dashboard or by email to support@mallorca.com. In the event of withdrawal, the amount paid will be refunded within 14 days.

5.7 Cancellation

Paid directory plans can be cancelled at any time at the end of the current billing period. After cancellation, the entry will be downgraded to the free plan. Amounts already paid will not be refunded on a pro-rata basis.

6. User Obligations

6.1 Lawful Use

The user undertakes to use the Mallorca.com Services only for lawful purposes and not to post content that violates applicable law.

6.2 Prohibited Content

The following content is prohibited:

  • Illegal goods or services
  • Stolen or counterfeit products
  • Weapons, drugs, prescription medications
  • Pornographic content
  • Discriminatory, offensive or violence-glorifying content
  • Spam, chain letters, pyramid schemes
  • Trademark or copyright protected content without permission
  • False or misleading information
  • Content that violates the rights of third parties

For content in the social features of the Mallorca.com app, section 13 applies in addition.

6.3 Own Content

The user guarantees that they are entitled to use the content they post and that it does not infringe the rights of third parties.

6.4 No Circumvention

It is prohibited to use the contact data of other users for purposes outside the specific transaction (e.g., advertising).

7. Role of Mallorca.com

7.1 Intermediary Role

Mallorca.com is a mediation platform and is not a contracting party in transactions between users. We do not sell, buy, rent or auction goods or services.

7.2 No Content Verification

Mallorca.com does not systematically verify the accuracy, completeness or legality of posted ads. However, we reserve the right to remove content that violates these Terms of Service.

7.3 No Transaction Guarantee

Mallorca.com does not guarantee the completion or execution of transactions between users.

8. Liability and Limitation of Liability

8.1 Liability of Mallorca.com

Mallorca.com is only liable without limitation in cases of intent and gross negligence, as well as in cases of injury to life, body or health. Otherwise, liability is limited to the typical, foreseeable damage of the contract.

8.2 User Responsibility

Users are responsible for their ads and their behavior on the platform. Mallorca.com is not liable for damages arising from transactions between users.

8.3 Availability

Mallorca.com strives to offer services without interruption, but does not guarantee permanent availability.

9. Rights to Content

9.1 Right of Use

By posting content, the user grants Mallorca.com a simple, worldwide, free right of use to publish and distribute the content on the platform, including automatic translation.

For content published through the social features of the Mallorca.com app, section 13.4 alone governs the grant of rights.

9.2 Intellectual Property

The Mallorca.com Services and all related content, trademarks and logos are intellectual property of Mallorca.com or third parties.

9.3 Business Content in the Directory

This section 9.3 applies only to directory entries whose owners have expressly accepted this version of the Terms of Service when claiming or creating the entry (sections 5.2 and 5.3); section 9.1 continues to apply to all other entries. For the photos and texts that these owners post to their entry, the following applies instead of section 9.1:

a) The rights to the content remain with the user. The user grants Mallorca.com a non-exclusive, worldwide right to reproduce it, communicate it to the public and adapt it, free of charge. Adaptation means: cropping, selecting portions, adjusting colour and format, combining with other content, animating, turning into short videos, machine translation, and using AI tools to modify it or generate new images and videos from it.

b) Mallorca.com uses the content to present and promote the business, its offers and Mallorca.com: on mallorca.com, in the app, in newsletters and on social media, including in paid advertising. Service providers and advertising platforms may process and deliver it for these purposes on behalf of Mallorca.com; Mallorca.com does not otherwise share it with third parties. On request, the business is named as the source.

c) Mallorca.com does not distort the content, use AI to alter the faces of identifiable people or show identifiable people in any context that gives a false impression of them. Images and videos generated or substantially altered with AI are labelled as such.

d) The right applies for as long as the content forms part of the entry. If the user deletes content or the contract ends, Mallorca.com removes it from the entry, makes no new use of it and stops paid advertisements using it without undue delay. Material already published, such as social media posts, newsletters and articles, may remain, unless a person depicted withdraws their consent or the law requires removal.

e) The user only posts content that they are entitled to use for these purposes. Identifiable people must have expressly consented to being shown, including in advertising and in edited form; the user informs Mallorca.com of any withdrawal of consent.

10. Duration and Termination

10.1 Duration

The usage contract is concluded for an indefinite period.

10.2 Termination by User

The user can delete their user account at any time through the account settings, thereby terminating the contract.

10.3 Termination and Blocking by Mallorca.com

Mallorca.com may terminate the contract with 14 days notice. In case of serious violations of these Terms of Service, we may block or delete the user account immediately.

11. Changes to Terms of Service

11.1 Right to Change

Mallorca.com may change these Terms of Service with reasonable notice (minimum 14 days). Changes will be communicated to the user by email or during use of the services.

11.2 Acceptance

If the user does not object to the changes within the set period, the changes are deemed accepted. The user will be informed of this legal consequence in the notification.

11.3 Right to Object

In case of objection, the user has the right to terminate the contract.

12. Final Provisions

12.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of the country of residence also apply.

12.2 Jurisdiction

For claims against Mallorca.com, jurisdiction is at the registered office of Mallorca.com, to the extent permitted by law.

12.3 Severability Clause

If individual provisions of these Terms of Service are invalid, the validity of the remaining provisions shall not be affected.

12.4 Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Social Features of the Mallorca.com App

13.1 Scope and Precedence

This section 13 applies to the social features of the Mallorca.com app: publishing your own posts with images and text, keeping a profile with a username, following others, liking posts, reporting posts and profiles, and blocking people. We are releasing further social features step by step — in particular videos, comments, direct messages and features for meeting people; publishing your own posts may at first be limited to individual accounts. The rules in this section 13 apply to a feature as soon as it is available in the app. There is no entitlement to have a particular feature enabled. The provider is — as for all Mallorca.com services — the operator named in section 1.1; its full company name and address are: MenzeMedia.de GmbH, Am Wunderhügel 27, 58644 Iserlohn, Germany.

Sections 1 to 12 apply to the social features in addition. Where this section 13 provides otherwise than sections 1 to 12 — in particular on the minimum age (section 2.2), on prohibited content (section 6.2) and on the right of use (section 9.1) — section 13 takes precedence for the social features.

Content of the social features is only content that you deliberately submit through a social publishing feature. Classified ads, directory entries, bookings and enquiries do not become such content merely because they appear in the app or in the feed. This section 13 changes nothing for content and matters outside the social features; it creates neither additional obligations nor additional rights of use in respect of such content and matters. This does not affect the fact that content of the social features may also be displayed on the website and in the other Mallorca.com services under section 13.4.

13.2 Minimum Age

You may use the social features only if you are at least 16 years old. A parent's or guardian's consent does not replace this minimum age. The statement "14 years" in section 2.2 does not apply to the social features. If you are 16 or 17, section 2.2 otherwise continues to apply: for your user account you need the consent of a parent or guardian.

Features for meeting people will, once we offer them, be open only to people aged 18 or over. We will explain how we check age for them before the feature launches.

To check the minimum age of 16, the app will ask for your date of birth as soon as we have enabled this prompt. We do not ask for an identity document or use biometric methods such as face recognition for this. For as long as the app does not yet ask for the date of birth, the minimum age applies all the same: use the social features only if you are at least 16 years old. Your date of birth is not displayed publicly. Once you have entered it, you cannot change it yourself; if it is wrong, write to us at support@mallorca.com.

If you are under 16, or if we receive concrete indications that you are, we block the social features of your account. Your account and the other Mallorca.com services are not affected. You will be given the opportunity to clear the matter up.

13.3 Your Agreement

Use of the social features requires that you have agreed to these terms. We obtain your agreement once: when you register or sign in to the app or, if your account already exists, before we enable the social features for you. After that we do not ask again for every post; when you publish, the app may remind you in a short note that these terms apply.

By way of exception to section 11.2, the following applies to this section 13: changes to your disadvantage only take effect for you once you have expressly agreed to them. We do not treat your silence as agreement in that respect. If you reject a change, your account and the other Mallorca.com services are not affected; we will then no longer be able to offer you the social features.

13.4 Your Content and Our Right of Use

The rights in what you publish in the social features remain with you or with the respective rights holder. So that we can display your content, you grant us a simple (non-exclusive), worldwide and royalty-free right of use in it, limited to the period for which the content is published. It allows us

a) to store, display and keep your content available in the Mallorca.com app and on the website mallorca.com, as well as in the other Mallorca.com services;

b) to prepare it technically as far as display requires — that is, to change file size, format and resolution, to create crops and preview images, to convert videos into other formats and to machine-translate text;

c) to show it within the Mallorca.com services wherever it fits by subject — for example in the feed, on a place or topic page, or in a selection;

d) to show it in a preview when someone shares a link to your post in another service.

We do not pass your content on to third parties for their own exploitation, and we do not sell it. Technical service providers that store or deliver content on our behalf are not third parties in this sense. We use an item of content in advertising for Mallorca.com only with your prior express consent.

The right of use ends when you withdraw the content or when it is deleted. Backup copies then expire within their usual period; copies that other people have already saved or forwarded are beyond our reach. If we have to retain an item of content because of a report or a breach of the law, we keep it blocked for as long as that is necessary.

We owe no payment for the use of your content. For content that you publish through the social features, this section 13.4 alone governs the grant of rights; section 9.1 does not apply to it.

13.5 What You Vouch For

By publishing, you assure us that

  • you hold the rights to what you upload, or have the permission of whoever holds them;
  • people who are recognisably shown agree to the publication, where their consent is required — for minors, their parents or guardians as well;
  • you do not use third-party trade marks, logos or protected works for which you lack permission;
  • the content does not breach section 6.2 or section 13.6.

If you culpably breach these assurances, you are liable in accordance with the statutory provisions. For content in the social features you do not give a guarantee irrespective of fault under section 6.3.

13.6 What Is Additionally Not Allowed in the Social Features

Section 6.2 applies here too. In addition, the following are not allowed in the social features:

  • photos or videos that recognisably show people without the required consent, unless those people are merely incidental to a scene
  • photos or videos from protected spaces such as homes, changing rooms, toilets or hospital rooms that violate the privacy or intimate sphere of others
  • harassment, threats, public shaming and calls for joint attacks on a person
  • publishing addresses, telephone numbers or other contact details of other people
  • content that shows or addresses minors in a sexualised way
  • depictions of self-harm, suicide or eating disorders that glorify them or give instructions
  • third-party music or sound recordings for which you hold no rights
  • content created or altered with artificial intelligence that is passed off as a genuine photo or video
  • invented reviews and faked reach

13.7 Music and Sound

You may use music, sound recordings, audiobooks or film excerpts only if you hold the rights to them. The fact that a song is widespread on other social networks is not permission. Where we provide our own selection of soundtracks in the app, you may use them for your posts in the social features; you do not have to grant us any rights in those soundtracks. If we receive a complaint from a rights holder, we may mute the soundtrack or remove the post.

13.8 Content Created with Artificial Intelligence

If your post was created or altered, wholly or in substantial part, with artificial intelligence, label it when you publish. Use the switch for this where the app offers it; if there is none, say so in the text of the post. This applies in particular where the content looks like a genuine photo or video of a place, a person or an event. The label is your statement; we may display it with your post. A false or missing label breaches these terms.

Where the app offers it, you can add a place to a post, set hashtags and link to pages inside or outside Mallorca.com. The following applies:

  • Do not set a place that reveals another person's home or whereabouts.
  • Use hashtags that match the content. Strings of identical hashtags used purely for more reach, third-party brand names used misleadingly and misleading keywords are not allowed.
  • Do not link to pages with malware, scams or content that is prohibited under section 6.2 or section 13.6. Links for commercial purposes must be recognisable as advertising.

13.10 Sharing Outside the App

Where the app offers it, you can share posts via a link in other services, and others can share your posts in the same way. A shared link may show a preview of your post. If the post is withdrawn or deleted, the link leads nowhere; preview images that another service has cached may, however, remain visible for a while. We have no influence over that.

13.11 Direct Messages

As soon as we enable direct messages in the social features, the following applies to them; this does not refer to messages about classified ads or to directory, property or booking enquiries:

  • They are meant for exchanges between users, not for advertising, bulk sending or chain messages.
  • Section 6.2 and section 13.6 also apply in messages.
  • You can block any sender and report any message.
  • We do not read messages. We see a message only if someone reports it to us or if we are obliged to by law or by an authority.
  • Messages are not end-to-end encrypted. Do not use them to send copies of identity documents, access credentials or payment details.

13.12 Profile and Username

Your username, your display name and your profile picture are publicly visible; on your posts they are also seen by people without an account. Who you follow and who follows you can be seen by other logged-in users.

Your username must not impersonate another person or organisation, must not use a third-party trade mark without authorisation and must not be offensive or misleading. We may withdraw a name if someone has a legitimate claim to it or if it breaches this rule; you can then choose a new one. Your username, display name and profile picture belong to your Mallorca.com account; a change therefore applies to your account as a whole.

13.13 Following, Likes and Blocking

You decide which users and which businesses from the directory you follow. If you like a post, the person who published it can see that.

If you block someone, existing follow relationships between the two of you are removed. You can no longer follow each other or open each other's profiles, and your posts are no longer shown to each other in the app. Publicly visible posts remain accessible to people who are not logged in; blocking does not change that.

13.14 Reporting and Point of Contact

You can report posts and profiles in the app; as soon as direct messages are available, individual messages too. You can give a reason and explain what it is about. If we have an email address for you, we confirm receipt of your report and inform you of our decision.

You can also reach us without the report function and without a user account at support@mallorca.com. This address is also our single point of contact for users and authorities under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act). You can write to us in German, English, Spanish or Catalan.

Do not knowingly make false reports. Anyone who repeatedly misuses the report function may, after a prior warning, be temporarily excluded from it; the route via support@mallorca.com remains open.

13.15 Our Decisions and Your Complaint

If content breaches these terms or applicable law, we may hide it provisionally, remove it, bar you from publishing or block the social features of your account. We choose the least restrictive measure that is sufficient. Measures taken because of a breach of this section 13 affect the social features only; we block or terminate the rest of your user account and the other Mallorca.com services only if the conditions of section 10.3 are met independently of this section 13.

If a logged-in user reports a post, it may be hidden provisionally and automatically until a person has reviewed the report. Hiding a post in this way is not a finding that there has been a breach; we review it promptly. A person decides on removal, reinstatement and all further measures.

If a measure affects you, we tell you what we did, why and on what basis, whether an automated procedure was involved and how you can challenge it.

You can object to the decision within six months of our notifying you of it: reply to our notice or write to support@mallorca.com and explain why you consider the decision wrong. A person reviews the case again, and we inform you of the outcome. If the measure was wrong, we reverse it. You have the same right if you reported something and do not agree with our decision. For decisions on reported profiles we can review your objection only while the report is still stored (180 days after it was received).

Your statutory rights remain unaffected, in particular your access to the courts.

13.16 Our Role

The social features are a hosting service: users publish their own content, and we provide the space for it. We do not adopt third-party content as our own and do not monitor it generally and on our own initiative. If we learn of unlawful content, we remove it or block access to it.

13.17 Withdrawal and Deletion

You can withdraw a published post in the app; it is then no longer displayed but remains stored in your account. You can request its deletion at datenschutz@mallorca.com. You can delete your account under section 10.2.

If you delete your account, we remove your posts including images and videos, your profile, your likes, and your follow and block relationships from the app and from the website. What remains:

  • for any of your posts for which a case (report, measure or complaint) still exists, the content saved for that case without reference to your account, as well as records of reports and measures, for the limited periods set out in the Privacy Policy; we keep no copy of your other posts; reports you made yourself are detached from your account;
  • information that we are legally required to retain, for example about payment transactions;
  • backup copies, until they expire as scheduled;
  • as soon as direct messages are available: messages you sent to others, in their inbox — without attribution to your profile.

Details, the 14-day grace period and the periods are set out in the Privacy Policy.

13.18 Display of Posts

Which posts from the social features are displayed depends essentially on their language and the time they were published; older posts by different authors are taken into account in rotation. The place selected in the app and your settings may influence the rest of the feed. There is no entitlement to a particular reach, placement or visibility.

13.19 Consumer Rights

If you use the social features as a consumer, you keep the protection of the mandatory consumer protection provisions of the country in which you have your habitual residence. You can also assert your rights before the courts of your place of residence.
