Mallorca compensation claims rejected by Consell Consultiu
The Consell Consultiu has rejected two compensation claims against the Balearic Health Service (IBSalut) in Palma, Mallorca, on 25 August 2026. One concerned the death of a man after he climbed four flights of stairs following treatment for coronavirus; the other related to an alleged missed diagnosis that later led to surgery.
The advisory body found no proven causal link between the medical care or patient transport involved and the harm claimed in either case.
Claim following coronavirus patient’s death
The man had spent several days at Son Espases University Hospital in the summer of 2023 with pneumonia and coronavirus. After discharge, health workers accompanied him home, where his wife said the building lift was out of service.
She said he climbed four floors despite having Parkinson’s disease, heart disease and a spinal injury that restricted his mobility. He was readmitted to Son Espases the following day after severe, repeated vomiting, later transferred to Hospital General and subsequently died.
His wife sought €322,240 from IBSalut. The Consell Consultiu said she had not supplied technical evidence to support the alleged failings, and concluded that the transport staff could not have known his medical conditions or forced him to take the stairs.
Second claim over initial urinary infection diagnosis
In a separate opinion, the body dismissed a €90,307 claim from a woman who attended a primary care emergency centre with abdominal pain in late 2021. Doctors diagnosed a urinary infection and prescribed medication.
When the pain continued, she went to Hospital de Inca in Mallorca, where she underwent surgery for appendicitis and peritonitis. She later said an intestinal obstruction required another operation and linked it to unsuitable dietary guidance after the first procedure.
The case officer and the Consell Consultiu both found that the care had been appropriate. The case file contained no evidence connecting the treatment to the injuries cited in her claim.
