Autism ruling backs school assistant for child

A child with an extreme form of autism could attend school with an assistant provided by the family after a court backed prosecutors’ case. The assistant is not employed by the school and is intended to help the child communicate. Spain’s Attorney General, Teresa Peramato, highlighted the case in the prosecution service’s annual report presented on Thursday at the start of the judicial year.

The education authority had refused to approve the arrangement. It instead offered a place at a special education centre a long way from the child’s home.

Prosecutors said that option would have broken the child’s link with their familiar surroundings. The court found that the principles of equality and the right to inclusive education were at stake, accepting the prosecution’s view that fundamental rights had been breached.

The order is not final. A cassation appeal against it is still pending.
