Balearic court win sinks Spain's private university rules

The Balearic Islands win a court challenge against Spain’s tougher rules for setting up private universities. The Supreme Court overturns the government decree because ministers did not justify rushing it through. On 8 October, Prime Minister Pedro Sánchez says his government accepts the ruling and is working on new rules.

The court says the unjustified fast-track process also left the government without the legal basis to skip an initial public consultation. Spain’s central government must pay €6,000 in legal costs.

Sánchez says the replacement rules will aim to stop universities becoming a business. Science, Innovation and Universities Minister Diana Morant says the government will defend public universities and the quality of Spain’s higher education system. The ruling settles the Balearic Islands’ challenge, but Sánchez says the government’s push for tighter rules is not over.
