Balearic Islands' challenge sinks university decree

Responsible for this content: Frank Menze

The Balearic Islands win their challenge to Spain’s university decree: the Supreme Court strikes down rules that made it harder to set up private universities. The court says the government did not justify rushing the decree through. That fast-track route skipped a consultation required unless there were legal grounds to leave it out.

The decree, dated 7 October 2025, covered the creation, recognition and authorisation of university centres. The court also orders Spain’s central government to pay €6,000 in legal costs.

On 8 October, the Conference of Rectors of Spanish Universities says the decree fell because of how it was approved, not because of what it proposed. The rectors still favour tougher quality checks. They say new universities and courses need sound academic plans, qualified teaching staff, suitable resources and demonstrable research activity.
