Mallorca court halts eviction of family with three children
Palma, Mallorca: a court temporarily halts the eviction of a family with three children from their home in Son Oliva. The eviction was due on Monday morning at 16 Jordi Andreu Alcover Street. The family learned of the court’s decision at about 09.00, according to Stop Desahucios Mallorca.
The court applied Royal Decree-Law 29/2026, also known as the Maricarmen decree. Spain’s Congress of Deputies had rejected the measure, but the Council of Ministers approved it again. It appeared in the Official State Gazette on Wednesday and took effect on Thursday.
Rent arrears after a job loss
This is the family’s second eviction case. The first followed the end of their tenancy agreement, and the tenants won. This time the case concerns unpaid rent.
According to Stop Desahucios Mallorca, the father lost his job and challenged his dismissal in court. The family could not pay the rent while the case continued. After he won and received an agreed payment, he tried to clear the arrears, but the owner had already begun legal action. One child has autism; another is undergoing tests to establish whether they have it too.
Questions over the rented home
Stop Desahucios Mallorca says the family signed a tenancy agreement for a home, although the premises are classified as a shop or office. The group also suspects the owner may be renting out other offices as homes without the required approval. That remains an allegation.
For now, the eviction is on hold. Both sides are seeking a way for the family to stay in the property.
