Ibiza illegal holiday flat sealed in €220,001 case

An illegal holiday flat in Eivissa, Ibiza, has been sealed off on Thursday, 17 September, stopping it from being used for tourist stays. The Consell d'Eivissa island council and Eivissa Local Police carried out the action. Its owner and the person marketing the property now face a proposed penalty of €220,001.

The case began with a ruling by the councillor responsible on 8 July 2026. Sealing the flat is a precautionary step intended to prevent any further tourist use while the sanction process continues.

The file treats the alleged offence as a very serious breach of the Balearic tourism law. That category covers advertising, arranging or selling tourist stays in homes that are not permitted for the activity or stand in unsuitable areas.

Such offences can bring penalties from €40,001 to €400,000. In this case, the proposed fine is €220,001.

The island council and Eivissa Town Hall say they have stepped up joint inspections and information-sharing over homes suspected of being marketed as tourist accommodation without permission. They say illegal tourist use can take homes out of residential use, cause problems for neighbours and undercut legal tourism businesses.
