Mallorca IBSalut row demands one lawyer for three cases
A Palma protest is demanding that three cases over one patient’s IBSalut medical records go before a single lawyer and court. Asociación Sílvia G demonstrated on Tuesday, 22 September, outside the Tribunal de Instancia, the Territorial Justice Administration and the Balearic Islands Bar Association. The patient has central sensitisation syndrome, the group said.
The dispute centres on two requests to correct the patient’s medical record and one request to see it. Asociación Sílvia G says IBSalut, the Balearic public health service, failed to deal with all three requests, prompting an administrative court challenge.
The association says people with central sensitisation syndrome do not have access to specialist doctors in the public health system. It claims important details are often left out of medical reports or that reports are refused. It also points to the right to correct a medical record and to access it, which it says is a fundamental right.
The group says each of the three applications asked for the cases to be joined and assigned to one lawyer and one court. But the Bar Association required a separate application for each matter, according to the association.
It says the dispute was then split into three. Two files were sent to the Madrid bar association, which has requested documents for both cases. A lawyer has already been appointed in Mallorca for the third application, where an appeal has been lodged.
The affected person then approached Mallorca’s Free Legal Aid Commission and the president of the Tribunal de Instancia, as the free legal aid law allows when a professional body does not answer an application, the association said. The court initially registered the submission, then cancelled it and referred it back to the Bar Association.
The person has now sent the filing by burofax to the president of the Tribunal de Instancia, with copies to the dean of the Bar Association’s governing board and the president of the Free Legal Aid Commission.
