Mallorca lifetime inheritance could extend to spouses

Mallorca spouses could pass on a protected share of an inheritance while both are alive: the Balearic Parliament takes the first step towards changing the law on Tuesday, 6 October. Meeting in Palma, MPs unanimously agree to consider a bill put forward by all parliamentary groups. That share, called the legítima, can currently be passed on during a person’s lifetime only between parents and children.

Stable couples would also qualify if they have been together for ten years and have descendants. The proposal, drawn up by the Advisory Council on Civil Law, also changes the rules for marriage agreements. Couples could sign them before or after the wedding, but an agreement signed beforehand would take effect only if they married within a year.

Some changes would cover Mallorca and Menorca; others would apply only to Eivissa and Formentera, reflecting differences in civil law between the islands. For now, Parliament has agreed only to consider the bill. The new rules are not yet in force.
