Mallorca, Spain: A son accused of persuading his father to transfer 36,000 euros while he had cognitive problems faces a pre-trial hearing in Palma on Thursday, 29 October. The Balearic Islands Provincial Court is due to hear the case at 9.30 am. Prosecutors allege a continuing fraud and want a six-year prison sentence.

The case goes back to September 2018. According to the prosecution, the father had begun to experience mild cognitive decline and could not clearly understand the consequences of some contracts. His son allegedly took advantage of this and talked him into making the bank transfer.

Prosecutors say the son later steered his father into rental contracts for his properties between 2019 and 2021, as the father’s condition worsened. The son allegedly kept rent paid between August 2022 and October 2023, along with 4,800 euros received after building work did not go ahead. The rent and the 4,800 euros were returned to the father.

In April 2021, the son also allegedly persuaded him to grant a notarised power of attorney, allowing the son to sign documents and handle matters on his behalf. Alongside the prison term, prosecutors seek a 3,600-euro fine and 36,000 euros in compensation for the father. The hearing comes before any verdict.
