Car Hire Insurance Mallorca: Deposit, Excess and the Tricks at the Counter
Anyone booking a hire car on Mallorca almost always ends up at the same point: the car rental desk, where additional insurance, a hefty deposit and questions about your credit card suddenly appear. The good news first: statutory third-party motor liability insurance is compulsory in Spain and included in every rental price – no one is allowed to force you into more expensive additional cover. The bad news: it's precisely at this point that many rental companies engage in upselling, which consumer protection bodies are now officially challenging. This guide explains what's actually included in the basic cover, how the excess (franquicia) and the deposit work, what happens if you don't have a credit card, and how a clean handover report can protect you against unjustified additional claims.

Third-party motor liability: what's actually compulsory at the car rental desk
In Spain, third-party motor liability insurance (responsabilidad civil) is a legal requirement and is automatically included in every rental price – regardless of which station on Mallorca you book. Anything beyond that is, according to the Spanish consumer organisation OCU, an optional extra that the rental company may offer but must not force on you. In practice, things are often communicated differently at the desk: staff present the basic cover as inadequate in order to sell more expensive packages.
The real problem rarely lies in the liability cover, but in the so-called basic collision damage waiver (CDW). This usually only covers damage to the hire car up to a certain excess – and in many basic tariffs explicitly excludes tyres, glass, the underbody and the roof. It's precisely this gap that is used at the desk as a sales argument for separate tyre and glass insurance.
| Type of cover | Included in the rental price | Optional at the desk |
|---|---|---|
| Third-party motor liability (responsabilidad civil) | Yes, legally required | – |
| Basic collision damage waiver (CDW) with excess | Usually yes | Excess reduction |
| Tyres, glass, underbody, roof | Generally not covered | Additional package at the desk |
| Theft protection | Partly included, partly not | Additional package possible |
| Additional driver | No | Fee per driver and rental day |
Note: Spanish third-party motor liability insurance is different from the German "Mallorca policy" (Mallorca clause), which some German motor insurers offer for driving other people's cars abroad. It mainly applies when you're privately driving someone else's vehicle – with a standard rental from a Spanish car hire company, liability cover is already provided by law.
Deposit and excess: how the blocking system at the rental counter works
The deposit is not a fee you pay, but a blocking of an amount on the main driver's credit card. This amount depends on the excess (franquicia) of your tariff: in basic tariffs it is usually between around 1.050 and 1.700 Euro, depending on the vehicle class and rental company. If the vehicle is returned undamaged, the bank releases the blocked amount again – however, depending on the credit card provider, this can take a few days.
| Vehicle class | Typical excess for basic cover | Deposit is blocked on |
|---|---|---|
| All common classes (small to premium cars) | approx. 1.050 to 1.700 Euro, depending on vehicle class and rental company | Main driver's credit card |
Please note: Debit cards (classic EC/Girocard) are generally not accepted by most rental stations for the deposit block, even though they sometimes work for the rental payment itself. Check the terms and conditions explicitly before booking to see whether a credit card is mandatory.
The trick with additional insurance: when it makes sense – and when it doesn't
At the counter, reducing or waiving the excess is usually offered at a significantly higher price than booking it in advance online. Alternative: a so-called excess cover insurance, which you take out independently of the rental company before your trip, and which reimburses the excess withheld by the rental company in the event of a claim. It's important to note that these policies only reimburse the damage after your advance payment to the rental company – so you still need a credit card with sufficient coverage.
| Coverage option | Timing | Typical characteristic |
|---|---|---|
| Reducing the excess at the counter | On site, spontaneous | Usually the most expensive option |
| Added in advance online with the rental company | At the time of booking | Cheaper than at the counter |
| Independent excess cover policy (third-party provider) | Before departure | Reimburses the excess retrospectively |
| German Mallorca clause/policy (motor insurer) | Before departure | Relevant mainly for privately borrowed vehicles abroad |
Note: Don't hastily forgo time to think it over at the counter. Read the contract document handed to you before signing – according to ADAC, the actual rental agreement only comes into effect with this signature; the online reservation alone is not yet a legally binding contract.
Rental car without a credit card: is that possible on Mallorca?
One of the most common questions before booking is whether it's possible to hire a car without a credit card. In practice, many rental desks on Mallorca strictly require the main driver to have a credit card in order to block the deposit. If the main driver doesn't have a credit card available, some rental companies will accept a second driver instead, provided they present their own credit card – however, this incurs additional second-driver fees, which quickly eat up any supposed savings.
| Situation | Typical response from the rental company | Consequence for you |
|---|---|---|
| Main driver with credit card | Standard case | Deposit is blocked directly |
| Main driver without credit card, second driver with credit card | Sometimes accepted | Additional second-driver fee |
| No driver with a credit card | Rental is often refused | Booking effectively not possible |
OCU complaint 2025: Why consumer advocates are taking action against major rental companies
In July 2025, the Spanish consumer organisation OCU officially filed a complaint with the Ministerio de Consumo against five major car rental companies – according to reporting by europapress.es dated 3 July 2025, over allegations of unfair contract clauses and a lack of transparency towards customers. This isn't a reason to avoid hiring a car altogether, but it is a good reason to read the terms and conditions more carefully than usual before booking.
| Rental company (named in the OCU complaint) | Allegation according to reporting |
|---|---|
| Centauro | Non-transparent clauses |
| Europcar | Non-transparent clauses |
| Goldcar | Non-transparent clauses |
| Hertz | Non-transparent clauses |
| Sixt | Non-transparent clauses |
Note: The mention of these companies refers exclusively to the publicly documented OCU complaint from July 2025 and is not a blanket assessment of the individual providers. Complaints about specific experiences can be submitted to the OCU (ocu.org) or the European Consumer Centre Germany (evz.de).
How can you really recognise a reputable car rental company?
Instead of a list of provider recommendations, what really helps you choose a rental company on Mallorca are hard criteria that you can check in the terms and conditions and in current reviews.
| Criterion | What you should look out for |
|---|---|
| Deposit transparency | Amount of excess and blocked amount clearly stated |
| Fuel policy | full/full instead of prepaying for a full tank |
| Counter reviews | Current, location-specific reports on upselling practices |
| Additional driver fees | Stated in advance in euros per day, not only on site |
| Cancellation conditions | Free cancellation possible up until shortly before the rental starts |
You can find an overview of local car rental companies — with Google reviews as a guide — in our business directory: Car rental in Palma and directly at the airport the Providers at Aeroport de Son Sant Joan.
Which documents do you need at the counter?
For renting a car on Mallorca, a valid EU card driving licence is generally sufficient; the British photocard driving licence is also accepted. The minimum age is usually 21, and for drivers under 25 a young driver surcharge is often charged.
| Document / Criterion | Note |
|---|---|
| EU card driving licence | Accepted |
| UK photocard driving licence | Accepted |
| Passport or national ID card | Required for identification |
| Credit card in the name of the main driver | Usually mandatory for the deposit |
| Minimum age | Usually 21 years old, surcharge under 25 common |
Handover and return protocol: how to document correctly
Most disputes surrounding the excess arise not from actual damage, but from a lack of evidence about the vehicle's condition at collection. A thorough protocol is your most important protection.
- Photograph and film the vehicle all round at collection, including timestamps and any existing scratches or dents.
- Enter any existing damage in the written handover protocol together with the rental company's staff and have it countersigned.
- Document the mileage and fuel level at collection.
- Photograph again at return and have the return protocol signed – ideally with a witness present.
- Keep all receipts (contract, protocols, photos, payment receipts) at least until the deposit has been fully released.
Caution:Without your own timestamped photos, it is significantly harder in a dispute to prove that damage identified on the return date did not occur during your rental period.
Fuel policy and other cost traps
Besides deposit and excess, there are typical additional costs that are easily overlooked when booking online. The full/full fuel policy – collect full, return full – is generally cheaper than prepaying for a full tank. Anyone who misses their collection appointment without cancelling in time also risks a so-called no-show fee.
| Cost trap | What's behind it |
|---|---|
| Prepaid full tank | Usually more expensive than refuelling yourself before returning |
| No-show fee | Due if collection is missed without timely cancellation |
| Additional driver without prior registration | Subsequent fee at the counter |
| Late return | Additional rental days or hourly fees |
Most common mistakes with car hire insurance on Mallorca
- Only taking out additional insurance at the counter under time pressure, instead of comparing options online beforehand.
- Not preparing a handover protocol with photos and later relying on verbal assurances.
- Bringing a debit card instead of a credit card, thereby jeopardising the rental at the counter.
- Only reading the terms and conditions on excess and deposit on site, rather than before booking.
- Not registering an additional driver in advance and consequently paying surprise fees at the counter.
- Relying on a statutory right of withdrawal for online bookings, which, according to the consumer advice centre, does not actually apply to car hire bookings.
What happens next? Accident, dispute and reimbursement
If an accident occurs during the rental period, you should report the damage immediately to the rental company and – depending on severity – to the police, and document the incident with photos. In disputes over a withheld deposit or damage charged after the fact, direct, written contact with the rental company as well as your own handover and return photos will help as evidence in the first instance. If this doesn't lead anywhere, you can turn to the European Consumer Centre Germany (evz.de) or – for rental companies based in Spain – to the OCU or the Ministerio de Consumo.
Checklist before booking your rental car on Mallorca
| Item | Done? |
|---|---|
| Excess and deposit amount checked in the terms and conditions | ☐ |
| Main driver's credit card with sufficient limit available | ☐ |
| Full/full fuel policy selected | ☐ |
| Additional driver registered in advance | ☐ |
| Cancellation terms and no-show policy read | ☐ |
| Decision made on excess cover policy | ☐ |
| Handover protocol and photo equipment prepared | ☐ |
Conclusion
Third-party liability insurance is a legal requirement for every rental car on Mallorca and is included in the price – anything offered additionally at the counter is optional and usually more expensive than an alternative arranged online in advance. Anyone who knows the amount of the excess, brings a valid credit card, and carefully documents both collection and return with photos significantly reduces the risk of unexpected additional charges. The OCU complaint from July 2025 shows that consumer protection organisations are actively monitoring the practices of individual rental companies – good reason to read contracts carefully before signing rather than relying on verbal assurances at the counter.
