Menzemedia GmbH ("Mallorca.com", "we", "us") operates under the name "Mallorca.com" a multilingual website and other services, local and mobile applications (hereinafter together "Mallorca.com Services").
These General Terms of Service contain the basic rules for using the Mallorca.com Services. Deviating terms and conditions of the user do not apply unless expressly agreed by both parties in writing.
The Terms of Service and Mallorca.com Services are available in German, English, Spanish and Catalan.
Using Mallorca.com Services may require registration. Through registration, a contract is concluded between the user and Mallorca.com for the use of the services.
Users must be of legal age or have consent from a legal guardian. In Spain, pursuant to LOPD, the minimum age is 14 years.
The user is obliged to provide truthful information during registration and keep it up to date. The user account is not transferable.
The user is responsible for the secure storage of their access credentials. In case of suspected misuse, the password must be changed immediately and we must be informed.
Posting classified ads for private users is generally free of charge. Mallorca.com provides a platform where users can publish ads.
Ads are automatically translated into all four languages (German, English, Spanish, Catalan). This translation is machine-generated and without guarantee of accuracy.
Mallorca.com acts as an intermediary and does not charge commissions on transactions between users. Purchases and sales are conducted directly between users.
Mallorca.com may offer paid additional services, such as:
Prices for paid services are clearly displayed before purchase. There are no hidden fees.
Payment is made in advance. Accepted payment methods are displayed at checkout.
Mallorca.com operates a business directory in which companies and service providers in Mallorca can be listed. The directory contains both automatically imported entries from publicly available sources and entries created or claimed by users themselves.
Commercial users can claim an existing directory entry, provided they are the legitimate owner or an authorized representative of the listed business. By claiming an entry, the user confirms that they are authorized to act on behalf of the business. Mallorca.com reserves the right to request proof of authorization.
Commercial users can create a new directory entry. Truthful and current information regarding company name, industry, location, and contact details is required. Mallorca.com assumes no liability for the accuracy of the information provided.
Different plans are available for directory entries:
The exact features and prices of each plan are displayed on the directory registration page. Paid plans are offered as monthly or annual subscriptions.
Payment processing for paid directory plans is handled by the payment service provider Stripe (see Privacy Policy). By ordering a paid plan, the user agrees to Stripe's terms of service.
A 14-day right of withdrawal from the date of contract conclusion applies to paid directory plans in accordance with § 355 BGB (German Civil Code). Withdrawal can be declared via the dashboard or by email to support@mallorca.com. In the event of withdrawal, the amount paid will be refunded within 14 days.
Paid directory plans can be cancelled at any time at the end of the current billing period. After cancellation, the entry will be downgraded to the free plan. Amounts already paid will not be refunded on a pro-rata basis.
The user undertakes to use the Mallorca.com Services only for lawful purposes and not to post content that violates applicable law.

The user guarantees that they are entitled to use the content they post and that it does not infringe the rights of third parties.
It is prohibited to use the contact data of other users for purposes outside the specific transaction (e.g., advertising).
Mallorca.com is a mediation platform and is not a contracting party in transactions between users. We do not sell, buy, rent or auction goods or services.
Mallorca.com does not systematically verify the accuracy, completeness or legality of posted ads. However, we reserve the right to remove content that violates these Terms of Service.
Mallorca.com does not guarantee the completion or execution of transactions between users.
Mallorca.com is only liable without limitation in cases of intent and gross negligence, as well as in cases of injury to life, body or health. Otherwise, liability is limited to the typical, foreseeable damage of the contract.
Users are responsible for their ads and their behavior on the platform. Mallorca.com is not liable for damages arising from transactions between users.
Mallorca.com strives to offer services without interruption, but does not guarantee permanent availability.
By posting content, the user grants Mallorca.com a simple, worldwide, free right of use to publish and distribute the content on the platform, including automatic translation.
The Mallorca.com Services and all related content, trademarks and logos are intellectual property of Mallorca.com or third parties.
The usage contract is concluded for an indefinite period.
The user can delete their user account at any time through the account settings, thereby terminating the contract.
Mallorca.com may terminate the contract with 14 days notice. In case of serious violations of these Terms of Service, we may block or delete the user account immediately.
Mallorca.com may change these Terms of Service with reasonable notice (minimum 14 days). Changes will be communicated to the user by email or during use of the services.
If the user does not object to the changes within the set period, the changes are deemed accepted. The user will be informed of this legal consequence in the notification.
In case of objection, the user has the right to terminate the contract.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of the country of residence also apply.
For claims against Mallorca.com, jurisdiction is at the registered office of Mallorca.com, to the extent permitted by law.
If individual provisions of these Terms of Service are invalid, the validity of the remaining provisions shall not be affected.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
